Most Serious IRS Problem – Processing Delays

Thursday January 12, 2023 – The Taxpayer Advocate Service (TAS) is an independent organization within the Internal Revenue Service (IRS) that helps taxpayers resolve problems with the agency. Each year, by law, the TAS releases a report to Congress highlighting the most serious problems encountered by taxpayers. The report, known as the National Taxpayer Advocate’s (NTA) report, identifies systemic issues that impede taxpayers’ ability to exercise their rights and recommends solutions to those problems.

The 2022 National Taxpayer Advocate report identified ranked the ten most serious problems encountered by taxpayers:

  1. Processing Delays
  2. Complexity of the Tax Code
  3. IRS Hiring & Training
  4. Telephone & In-Person Service
  5. Online Access for Taxpayers and Tax Professionals.
  6. E-File & Free File
  7. IRS Transparency
  8. Return Preparer Oversight
  9. Appeals
  10. Overseas Taxpayers

The biggest issue identified in the report is Processing Delays. That finding isn’t news to any taxpayer. The processing delay has been reported since last year.

The recently replaced IRS Commissioner, Charles Rettig told a Congressional hearing last March the backlog would be cleared by the end of 2022.

In the just released report the National Taxpayer Advocate, Erin Collins, wrote to Congress, saying ““We have begun to see the light at the end of the tunnel, I am just not sure how much further we have to travel before we see sunlight.”

So, the IRS did not clear the backlog by the end of 2022, despite the additional funding to do so. The additional funding BEFORE the additional $80 billon.

New Congress First Target – IRS

Wednesday January 11, 2023 – With the new House Majority, Republicans are pledging to use their power to identify agencies at which to slash budgets. Their vote on Monday was the first step in this process, passing a repeal of $71 billion in IRS funding.

The Inflation Reduction Act was passed by Democrats in the last Congress – without a single Republican vote. It was designed to provide funding over 10 years to boost enforcement at the IRS after massive hiring surges.

It’s important that business owners stay informed about any changes related to taxes and filing procedures so they can comply with all requirements quickly and accurately. Keeping up-to-date on any news related to taxes is critical – especially as tax season approaches – so businesses can remain compliant while also taking advantage of any benefits they may be entitled to receive under current laws. Additionally, making sure you have accurate records and staying organized throughout the year can help reduce any potential issues down the line if you do get audited or need help with a specific issue related to your taxes or filing status.

GOP Wants to Shrink IRS by $70 Billion

Monday January 9, 2023 – The recently seated Republican majority recently proposed a bill that would cut the IRS budget by $70 billion.

This proposal has been met with mixed reactions from both sides of the political aisle, as it would drastically reduce the proposed growth of IRS services and enforcement capabilities.

IRS Sets Date For 2022 Tax Season

Today, Monday January 10, 2022, the IRS has set the date of January 24, 2022 to officially open tax filing season, 19 days earlier than last year. That’s the first day the agency will start accepting and processing 2021 federal tax returns.

The IRS encouraged taxpayers to file electronically with direct deposit to receive their tax refunds as soon as possible. The IRS claims taxpayers should receive their refunds within 21 days of filing their return electronically if they use direct deposit and as long as there are no issues with the return.

Remember, the IRS offers a Free File program. That program will open Jan. 18 for taxpayers who made $73,000 or less in 2021. We will provide additional information on that program soon.

This year, your return is due by April 18, 2022 because Washington D.C. celebrates Emancipation Day on April 16th, can April 16th is a Saturday. Federal employees in Washington D.C. have the day off the closest week day when that happens – Friday April 15, 2022. That pushes the deadline to Monday April 18, 2022.

Supreme Court Stealing Our Liberty

Over the next several weeks I am going to review recent Supreme Court of the United States (SCOTUS) opinions that, in my opinion, evidence of our diminishing liberty. Each time the SCOTUS decides a case that is clearly not based on the Constitution or the actual language of the statute – the citizens lose; even if one may agree with the outcome.

The four cases from this last session I will review are KING ET AL. v. BURWELL (King v. Burwell), SECRETARY OF HEALTH AND HUMAN SERVICES, ET AL., ARIZONA STATE LEGISLATURE v. ARIZONA INDEPENDENT REDISTRICTING COMMISSION (Az State Legislature v. AIRC), OBERGEFELL ET AL. v. HODGES, DIRECTOR, OHIO DEPARTMENT OF HEALTH, ET AL. (Obergefell v. Hodges), and TEXAS DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS ET AL. v. INCLUSIVE COMMUNITIES PROJECT, INC., ET AL. (Texas DOHCA v. ICPI).

Let’s begin with a summary of each case and the issues the court faced. King vs. Burwell is the case involving the Affordable Care Act (ObamaCare). The court was asked to determine if the words “Exchange established by the State” means “Exchange established by the State.” In Obergefell v. Hodges, the court was asked to determine if the Constitution Regquires every state in the Union to recognize same sex marriage. The Court in AX State Legislature v. AIRC was asked if the word “Legislature” really means “The people.” And finally, in Texas DOHCA v. ICPI the court was asked if discrimination, to be actionable, must be intentional, or can a statistical analysis showing “disparate impact” on minorities be enough to prove “unconscious prejudices.” such a way as to make the statute unnecessary.

The SCOTUS, with these decisions, has eroded all of our freedoms. This trend is only growing more brazen with each passing term. If our Constitution and our statutes mean what 5 judges say it means, no matter the words used, then we are no longer a nation of laws – we have become a nation of subjects.

Justice Scalia, Thomas and even Roberts have some harsh words for their colleagues dissenting from these decisions. At least they recognize the danger we are all in when our Constitution becomes a “living breathing document,” with absolutely no meaning at all. Many have fought and died for that document. All of our federal leaders have taken an oath to uphold the Constitution. These decisions should demonstrate the disconnect between that oath, and their actions.
