If you owe the IRS back taxes and you are unable to pay, Opem Tax Resolution may be able to have the IRS designate you as “IRS Currently Not Collectible.” IRS Currently Not Collectible does not resolve your tax obligation to the IRS, it simply stops the IRS collection activity against you. In order to qualify for IRS Currently Not Collectible status you must prove that you don’t have disposable income available to pay the IRS.
In order to do that, Opem Tax Resolution will conduct a through investigation of your IRS obligations and your ability to pay. In order to prove you are currently unable to pay the IRS we will complete a version Form 433 and substantiate your income and expenses. We would need:
- 6 Months of pay stubs for each job;
- Most recent statements for all other monthly income that you receive, such as Social Security benefits, pension or retirement income, etc.;
- Most recent real estate tax bill for all property that you own, even if the property is owned with someone else. You also need to know the date you bought the property and what you paid for it;
- Utility bills for each utility–electricity, water & sewer, gas, telephone, etc.;
- Your Lease or mortgage statement showing your monthly rent or mortgage payment;
- Copy of your most recent credit card statements;
- Vehicle Information. Including make, model, mileage and proof of your monthly payment for each car you own;
- Proof of any other assets you own, such as stocks, bonds, etc.;
- Proof of any other monthly expenses you have, such as food and other necessities, daycare, medical expenses, court ordered payments such as spousal or child support, etc.
Once Opem Tax Resolution convinces the IRS to designate your IRS debt as IRS Currently Not Collectible, the IRS must stop all collection activities, including levies and garnishments.
Now, the IRS may re-evaluate your case in a year or two to determine if the IRS Currently Not Collectible status still applies. If it does, the IRS will continue the designation of IRS Currently Not Collectible. While your status of IRS Currently Non Collectible continues, the 10-year statute of limitations continues to toll. If the IRS cannot collect the tax within the 10-year statutory period, then your tax debt will expire.
